St. Cloud DWI Lawyer Defends Even the Toughest Cases

Attorney has three decades of experience with drunk driving cases

Driving while impaired (DWI) by alcohol or a controlled substance is a serious crime. Minnesota law sets the blood alcohol limit at 0.08 percent for drivers of non-commercial vehicles and 0.04 percent for commercial drivers. If the police suspect that you are intoxicated, you could lose your license just for refusing to take a blood, breath or urine test.

Having an experienced DWI attorney on your side is crucial. Michael J. Michalski, founder of the Michalski Law Office, is a St. Cloud DWI attorney who will work hard to get your DWI dismissed or the penalties reduced.

Will I lose my license if I am arrested for DWI?

In Minnesota, a number of administrative sanctions may take effect after a DWI arrest. These include:

  • License revocation: Your license can be temporarily revoked  for 90 days or more while your case is pending.
  • Plate impoundment: The license plates are seized from the  vehicle in which the DWI was committed, along with the plates from any  other vehicle owned, registered or leased by the suspect.
  • Vehicle forfeiture: If this is a third DWI offense  within 10 years, the vehicle the suspect was driving when the offense occurred  may be seized by the arresting officer and held by the state.

A seasoned criminal law attorney can help you avoid serious sanctions after a DWI arrest. Contact the Michalski Law Office as soon as possible after your arrest.

Conviction carries serious penalties

A DWI can be a misdemeanor, gross misdemeanor or felony, depending on whether there are aggravating factors, such as:

  • A prior DWI conviction
  • A blood alcohol level of  0.2 percent or greater
  • A child younger than 16 in  the vehicle at the time of the offense

At sentencing, the judge will consider these factors, and can impose a maximum fine of $14,000 and seven years in prison. With so much at stake, you can’t afford to be represented by anyone less than an experienced criminal defense attorney such as Michael J. Michalski.
